These Terms & Conditions (“Terms”) govern your use of sarlenphoto.com and the website features provided by Sarlen Studios Photography (“Sarlen Studios,” “we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, please discontinue use of the website.
These Website Terms do not replace a photography services agreement. A proposal, booking agreement, invoice, model release, or other written document issued for a specific session or event may contain additional terms. If a specific signed agreement conflicts with these Website Terms, the specific agreement controls for that service.
1. Website Information
The website provides general information about Sarlen Studios, photography services, portfolio work, pricing, planning guidance, and ways to contact us. We make reasonable efforts to keep the information accurate and current, but availability, package details, prices, locations, travel charges, delivery estimates, and other service information may change.
Submitting an inquiry does not guarantee availability, reserve a date, or create a photography-services contract.
2. Inquiries and Booking
A session or event is booked only after Sarlen Studios confirms availability, the applicable agreement is signed, and the required payment is received.
Unless a different written agreement applies:
- A signed agreement and a non-refundable 30% retainer are required to reserve the date.
- The remaining balance is due before the session or event.
- Credit/debit cards and cash are accepted.
- Customized scope, travel, permits, production expenses, additions, and payment plans must be confirmed in writing before they apply.
An inquiry response, preliminary conversation, or requested date is not a reservation until the booking requirements are complete.
3. Rescheduling, Weather, and Studio Changes
A client may request a date change at least three days in advance without a rescheduling penalty, subject to availability. A request made with less notice, a cancellation, a missed appointment, or a change affecting third-party expenses may be handled under the specific booking agreement and may involve loss of the retainer, a rescheduling fee, or unrecoverable costs.
Outdoor sessions affected by unsuitable weather may be rescheduled without penalty. Sarlen Studios determines whether conditions are reasonably suitable for the planned photography, taking safety, equipment, light, access, and the intended result into account.
If Sarlen Studios cannot provide the booked service, a new date will be offered. If no new date can reasonably be agreed, payments corresponding to the unavailable service will be returned as described in the applicable agreement.
4. Arrival and Session Time
A 15-minute grace period is provided. Arriving later may reduce the available session time so that later appointments or venue schedules are not affected. A substantial delay may require rescheduling and may result in the rescheduling fee communicated for the booked service.
Clients are responsible for arriving prepared and for communicating delays, access restrictions, mobility considerations, schedule changes, or other circumstances that may affect the session.
5. Locations, Travel, and Permissions
Base pricing applies at Sarlen Studios unless otherwise stated. Travel within or outside the Orlando area, permits, parking, admission, venue fees, and location-specific requirements may result in additional charges disclosed before booking or approval.
The client is responsible for identifying private-property, venue, or event restrictions that are within the client’s control. Sarlen Studios may assist with planning but cannot guarantee that a third-party location will remain available, unchanged, or free of restrictions.
6. Creative Services and Deliverables
Photography is a creative service. By booking Sarlen Studios, the client acknowledges the visual style shown in the portfolio and allows reasonable professional discretion regarding posing, lighting, composition, selection, editing, retouching, and delivery.
- Final photographs are delivered as edited high-resolution JPG/JPEG files in accordance with the booked package.
- RAW or original camera files are not delivered.
- The number of photographs, selection process, delivery method, delivery estimate, and included revisions depend on the booked service or package.
- Delivery estimates may be adjusted when circumstances outside reasonable control affect production, provided the client is informed when appropriate.
Because people, weather, venues, timing, and events are not completely controllable, Sarlen Studios cannot guarantee an exact recreation of another photograph, inspiration image, pose, expression, background, lighting condition, or moment.
7. Client Cooperation and Safety
The client agrees to provide accurate information, cooperate with reasonable preparation and safety instructions, and ensure that participating adults and the parents or guardians of participating minors understand the session plan.
Sarlen Studios may pause, modify, or end a session when continuing would create an unreasonable safety risk, violate location rules, involve harassment or unlawful conduct, or place participants, equipment, staff, or the public at risk.
8. Copyright, Client Use, and Promotional Use
Copyright ownership and the client’s permitted use of delivered photographs are governed by applicable law and the specific photography agreement. Purchasing photography services or receiving image files does not by itself transfer copyright or grant commercial-use rights beyond those stated in writing.
Clients may not remove copyright notices, falsely claim authorship, sell, license, materially alter, or use photographs commercially unless the applicable agreement or written permission allows it.
Sarlen Studios uses client photographs in its portfolio, website, social media, advertising, or promotional materials only with client authorization. Any model release or promotional-use permission should be documented separately or in the booking agreement.
9. Materials Provided by the Client
If a client provides logos, artwork, music, reference material, decorations, text, or other content for a session or deliverable, the client represents that they have permission to use it. The client remains responsible for third-party rights connected to materials they provide.
10. Minors
A parent or legal guardian must authorize services involving a minor and is responsible for attendance, supervision, and permissions unless another written arrangement is approved. The website is intended for adults arranging photography services and is not directed to children under 13.
11. Third-Party Services and Links
The website may link to Google Maps, WhatsApp, Instagram, payment services, gallery platforms, venues, or other third parties. Sarlen Studios does not control third-party websites, availability, security, content, or privacy practices. Use of those services is subject to their own terms and policies.
12. Website Content and Acceptable Use
The website design, text, branding, graphics, and photographs are owned by Sarlen Studios or used with permission and are protected by applicable intellectual-property laws. You may view and share ordinary links to public pages for personal, noncommercial purposes.
You may not:
- Copy, republish, sell, scrape, or commercially exploit website content without permission.
- Attempt to access restricted systems or interfere with website operation or security.
- Submit malicious code, spam, fraudulent inquiries, or unlawful material.
- Use the website or its content to violate another person’s rights.
13. Disclaimer and Limitation
The website is provided on an “as available” basis for general information. To the fullest extent permitted by law, Sarlen Studios disclaims warranties concerning uninterrupted access, the absence of technical errors, or the suitability of general website content for a particular purpose.
Terms governing liability for a booked photography service belong in the applicable photography agreement. Nothing in these Website Terms excludes or limits a right or remedy that cannot lawfully be excluded or limited.
14. Privacy
Our collection and use of information through the website are described in the Privacy Policy.
15. Governing Law
These Website Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute concerning a separately booked photography service may also be governed by the dispute provisions of the applicable agreement.
16. Changes to These Terms
We may update these Terms when the website, services, or business practices change. The revised version will be posted on this page with an updated effective or revision date. Continued use of the website after an update means that the updated Website Terms apply to later website use.
